By using TandaBuilder, browsing tandabuilder.com or purchasing a license, you agree to these terms. If you do not agree, please do not use the application or proceed with the purchase.
TandaBuilder is available through two distinct sales channels, each governed by different rules.
From the App Store, two options are offered:
The subscription automatically renews at the end of each period unless cancelled via your Mac's Settings (Settings > [Your Name] > Subscriptions). Cancellation takes effect at the end of the current billing period. The lifetime purchase gives you access to the current version of TandaBuilder and its minor updates; it does not automatically include future major versions.
App Store purchases are managed by Apple (StoreKit). TandaBuilder does not store your payment information.
A TandaBuilder Pro lifetime license can also be purchased directly on our website, for €49.99 (one-time payment), via Stripe Checkout. After payment, a license key is sent to you by email at the address provided at checkout.
The following applies only to purchases made directly on tandabuilder.com (Stripe channel). App Store purchases are governed exclusively by Apple's policy (see §5).
Under European distance-selling regulations, you have 14 days from the purchase date to exercise your right of withdrawal, without having to give a reason.
Exception for digital content: under Article L221-28 13° of the French Consumer Code, this right cannot be exercised once you have expressly consented, before payment, to receive your license key immediately and have expressly waived your right of withdrawal. This consent is collected at the time of payment, through mandatory acceptance of these terms. If you believe you did not give this consent knowingly, you may request cancellation and a full refund within 14 days of purchase by writing to contact@tandabuilder.com.
App Store: managed by Apple via StoreKit - check your Mac's Settings or contact Apple Support. Direct purchase: managed by Stripe - TandaBuilder does not store any payment information (card number, etc.), Stripe processes payments under its own privacy policy.
App Store: refunds are handled exclusively by Apple, according to their policy. To request one, contact Apple Support via reportaproblem.apple.com.
Direct purchase (Stripe): beyond the right of withdrawal described in §3, a refund may be granted in case of a proven malfunction preventing normal use of the application. Contact contact@tandabuilder.com describing the issue encountered.
App Store: use the "Restore purchases" button in the application, from any device signed in with the same Apple ID. Direct purchase: your license key was sent to you by email; if lost, write to contact@tandabuilder.com with the email address used at checkout.
TandaBuilder is protected by intellectual property laws. All rights reserved to Jan TUMPACH-LEGO. You remain the owner of your music files and local library; TandaBuilder claims no rights over them.
When you share a tanda or a playlist by file or by link, or publish, with a Pro license (direct purchase, §2.2), a milonga you played on your DJ page on tandabuilder.com, the following rules apply. Sharing by link is done from a tandabuilder.com web account, open to everyone, with or without a Pro license. What that content contains, and what it never contains, is detailed in the privacy policy.
You keep all your rights over the sets, tandas, playlists and texts you share or publish. You grant us, for the duration of the publication or the share, a non-exclusive, royalty-free license limited to what is necessary to host them, display them on tandabuilder.com, serve them by link and make them available to medialuna.org, our events platform, through a public feed. This license ends as soon as you withdraw the content, subject to copies that third parties or search engines may have made in the meantime.
Anyone may view published content, draw inspiration from it, replay the tracks they own and open it in TandaBuilder for their own use. The attribution to its author remains visible on an imported tanda as long as it is not modified. It is not permitted to republish another DJ's set or tanda while presenting it as one's own, on tandabuilder.com or elsewhere. Nor is it permitted to systematically extract or reuse a substantial part of the content published on the site. What you publish is never music: only metadata.
You publish under your DJ name and you are answerable for it. You warrant that you have the right to publish what you publish. You do not name a natural person without their consent; a venue or an event may be named when they are public. You publish no content that is unlawful, misleading, abusive or infringing the rights of others.
You may withdraw content at any time, from the application where it allows it or by writing to us; the site is rebuilt without it, usually within minutes and at the latest the next day. We may remove without notice content that breaches these terms or the law; we then inform you, with the reason, and you may contest by writing to us. Anyone may report content to us, or request the removal of content that names them, at contact@tandabuilder.com, giving the page address and the reason. We review content only upon notice, by hand, with no automated filtering, and we respond as promptly as we can.
Published pages are hosted by Cloudflare, Inc. (see §9), sharing and publication data on our server in Europe. Publishing, where offered, comes at no extra cost with the Pro license. The number of shared or published items per account is capped; the cap is shown in the application. We do not guarantee uninterrupted availability, and the service may change or end for a legitimate technical, legal or economic reason, with reasonable notice; your content stays on your Mac in any case.
